Divorce & Property Division

Divorce is a process in which the legal relationship between couples ends. In divorce cases, issues such as property sharing, alimony, and child custody also come to the fore. According to the Turkish Civil Code, property sharing is based on the principle of equality between spouses, but a fair share is decided by considering the duration of the marriage, the spouses' contributions, and other factors.

Statistics:
In Türkiye, 40% of divorce cases in 2023 resulted in property sharing and alimony requests. Divorce rates, especially in big cities, are 15% higher than in rural areas.

Important Subheadings:

  • Property Regime and Sharing: How to divide property between spouses.

  • Alimony Arrangements: Alimony payments and calculations after divorce.

Children's Rights & Custody

In divorce cases, the best interests of the child are the primary consideration. In custody cases, the decision on which parent the child should live with is made by considering factors such as the child's psychological and physical condition and the environment in which they live. In Türkiye, the responsibilities for the child's education and care are generally shared equally, but the courts make special assessments for each situation.

Statistics:
As of 2023, 30% of divorce cases in Türkiye involve child custody disputes. In 65% of custody cases, children remain with their mothers.

Important Subheadings:

  • Best Interests of Children: Deciding which parent the child will live with.

  • Parenting Rights and Challenges: Shared custody and equal parenting rights.
